IVC Filter Lawsuits
Recent studies suggest that IVC filters, which are used to treat pulmonary embolism, are breaking in a large number of patients and causing serious injuries. These studies suggest that 1 in 4 IVC filters break off inside the body. The metal shards then travel into vital organs and cause serious injuries and in some cases death. There has already been the creation of a IVC Filter Multi District litigation (MDL) due the increasing number of IVC filter lawsuits that have been filed. The FDA received at least 1,000 reports of adverse events since IVC Filters were introduced in 2005.
The IVC Filters look similar to a metal spider when it is inserted into the body. IVC filters are designed to “catch” blood clots caused by deep vein thrombosis before they enter the lung causing pulmonary embolism. These IVC filters should be removed as soon as threat of pulmonary embolism subsides. However many patients wait years after the filters are implanted. The manufacturers include Cook Medical, CR Bard and B. Braun. An inferior vena cava filter or IVC Filter is a filter that is placed inferior vena cava to prevent pulmonary emboli. The IVC lawsuits claim that the manufacturers failed to warn both patients and doctors of the risk that these filters can splinter off into the body cause dangerous IVC Filter side effects. These IVC dangerous side effects include:
- Severe Heart Pain
- Pulmonary Embolism
- Respiratory Compromise
- Hemorraging
- Death
IVC Filter MDL
There has been the creation of a IVC Filter MDL in Southern Indiana against Cook Celect. In a recent legal decision regarding CR Bard IVC Filter lawsuits, a federal judge denied a motion to seal materials after Bard reached a settlement in a IVC Filter lawsuit. The Cook IVC Filter Multi-District litigation will consolidate all the lawsuits and improve the efficency of the process. Plaintiffs will be able to perform discovery, conduct depositions. Later in the IVC MDL there will likely be Bellweather trails which could set the tone for the IVC Filter litigation. These IVC Filter Bellweather trials help both the plaintiffs and the defense understand how juries respond to a IVC filter lawsuit. These lawsuits come after the FDA sent multiple warnings regarding IVC filters and dangerous side effects. There is no word if there will be a Bard IVC Filter MDL, but there have been rumors of them quietly reaching settlements on IVC filter lawsuits.
