Southeast Texans remember Joe Jamail amid death

December 28, 2015, 9:13 am

By David Henry and Eric Besson

Joe Jamail, the Texas billionaire who became the richest practicing attorney in the U.S. after winning jury verdicts in civil lawsuits that included a $10.5 billion award for Pennzoil Co. in its landmark case against Texaco Inc. during the 1980s, died on Wednesday. He was 90.

His death was confirmed by Christopher Roberts, a spokesman for the University of Texas School of Law, in Austin, where Jamail was an alumnus and supporter. He died in Houston from complications with pneumonia, the Austin American-Statesman reported, citing university officials it didn't name.

Dubbed the "King of Torts" for his victories against large corporations, Jamail was lead counsel in more than 200 cases that resulted in verdicts or settlements of at least $1 million for clients in personal-injury matters. His representation of Pennzoil in a case against Texaco over the purchase of Getty Oil Co. led to a record jury verdict of $10.5 billion and helped make him one of the United States' most sought-after lawyers during his five decades in practice.

'He would kick ass and take names'

Jamail's aggressive, confident, skillful style made an impression on Southeast Texas attorneys.

"Lawyers of that stature are normally cordial or professional in most circumstances," Beaumont trial attorney Brent Coon said. "He kind of broke the mold on that. ... I kind of liked that about him."

Buddy Low, who practices at Orgain Bell and Tucker in Beaumont, tried about four cases with Jamail, whom he called a "great friend."

"You couldn't have a better friend," Low said. "Or you couldn't have a worse enemy."

Low said Jamail had the ability to rise to the moment and play to his audience.

"Joe could be really mean and tough, or he could be a little boy if he wanted to," Low said. "He played the role he needed to."

The best advice Jamail gave to Beaumont trial attorney Wayne A. Reaud, who knew him for decades: "The trial lawyer is a courtroom politician, and there are 12 votes," he said.

Jamail was a "genius," Reaud said.

"There were probably guys that Jamail went to trial with on a regular basis who had a much higher IQ than Joe, but they couldn't beat him," Reaud said. "He was a fire-breathing dragon as a champion for his clients."

One case Jamail tried in Beaumont was representing plaintiffs in the 2012 Thanksgiving Day pile-up on Interstate 10. The children of two Pearland residents killed in the crash involving more than 100 cars sued a trucking company. After six days of trial, a confidential but "record-setting" settlement was announced by the Beaumont firm Provost Umphrey, which was Jamail's co-counsel.

Jamail exemplified an "old guard of plaintiffs' attorneys," who could detail esoteric aspects of a case without sounding condescending, show empathy to juries and weave in narratives and parables to frame his arguments, Coon said.

"He would kick ass and take names and the whole jury loved him during the process," said Jefferson County District Attorney Bob Wortham, a former district court judge.

But Jamail also deployed a technical skill: He could condense a complicated case to the important issue, focus on it and win the argument, Wortham said.

"He would make his case because he didn't deal with the insignificant issues in the case," Wortham said.
