Settlement Reached in Dupont Gas Leak Lawsuit

October 14, 2015, 10:03 am

One of the four fatality lawsuits arising from the DuPont facility tragedy last November in La Porte has settled. Confidential settlement terms of the multi million dollar lawsuit were reached with the estate representative of DuPont employee, Crystle Wise, an  operator at the Lannate Unit who was overcome by toxic gases along with three of her coworkers. The plant was subsequently blistered by OSHA investigators who cited the facility with a dozen serious safety and health violations and also by the U.S. Chemical Safety and Hazard Investigation Board in an interim report released to the public last week. Safety failures included a lack of proper warning systems, respiratory protection and ventilation systems,  along with a handful of other major deviations from industry and DuPont’s own safety system protocols. While the terms of the financial compensation will remain confidential, it was also conditioned upon DuPont’s willingness to have a moment of silence recognizing the tragedy and those killed on the anniversary of the incident system-wide for the next decade and commit to a significant contribution to the American Humane Society in Crystle’s  honor.
 
Jasmine Wise, the only child and representative of the estate of Crystle Wise, had this to say:
“My family recognizes that money will not bring my mom back. Hopefully, getting everyone at DuPont to take a moment every year to remember our losses will also help them remember to do all the right things going forward so that tragedies like this do not happen again. My mom was a huge animal lover and I'm proud of the fact that something will be done with the local Humane Society chapter in her memory. I hope the settlement leads to saving human lives in this industry and also the lives of the animals my mom loved so much. My mom was a very kind and generous person and she moved and went to work at this plant just last year to be closer to me and my young son.  I know in my heart  that she is proud of the actions I have taken to try to make something good out of something so horribly bad.”

Our law firm has  decades of history  working with families in these situations craft settlement agreements in a manner to remember what went wrong, and why,  and most importantly not to repeat it. We hope that a required moment of silence of all DuPont employees across America every year reminds them of what terrible things can happen almost in the blink of an eye, and helps each and every one of them always put safety first. We know that refineries and chemical plants can be run safely if they are run competently, efficiently and with integrity. With Texas law so protective of corporate malfeasance with low caps on lawsuit damages and other protections, we have to look more and more to options other than money to make a difference in this industry.  Large corporations look at a million here or a million there as chump change, and with governmental fines so small, and legal liability so limited, it has created a reckless atmosphere that goes relatively unpunished. 
 
“Every worker in America deserves the right to know that they will be able to leave the job in their vehicle and not in a coffin. I'm very proud of  these courageous decisions Jasmine has made in this case with the support of Crystle’s parents, and the family’s continued ability to think about others even in their own time of grief. Every person, and every company, should be judged not by their words but by their deeds. DuPont has talked up their industry leadership in safety for decades. Unfortunately, from what we have proven in this case and what we know from a string of recent fatalities and injuries at other DuPont facilities, they have not been practicing what they preached. Hopefully the fact that they are now on the OSHA serious offender list and the fact they are willing to remind all of their workforce every year of this last tragedy, they will begin to take steps in the right direction to restore a true safety conscious mentality to their corporate culture. They said they were sorry today, and they are going to improve, and we will watch to make sure they live up to those commitments”.
