At DuPont La Porte plant hearing, families call for accountability

The families of four workers killed in a Nov. 15 chemical plant gas leak are calling for greater accountability for DuPont management in response to the release of a U.S. Chemical Safety Board report that outlines major safety failures at the company's La Porte plant.

Four workers – Crystle Wise, shift supervisor Wade Baker and brothers Robert and Gilbert "Gibby" Tisnado – were killed when nearly 24,000 pounds of toxic methyl mercaptan spewed into a tower at the La Porte plant.

At a hearing Wednesday night, before a Houston crowd of about 200, the CSB's four-person board unanimously approved interim recommendations for DuPont to help bolster protections for workers and those living in the surrounding area.

Diana Tisnado, who attended the hearing, remembers how her two sons, Robert and Gibby, often returned from their shifts with their clothing smelling strongly of chemicals. She often worried about the fumes they were breathing while on the job.

After the vote, Tisnado said she hoped the recommendations would spur industry change and hold DuPont accountable. No other families should have to suffer as hers has, she said.

"I hope they really make DuPont do what they say they're going to do," she said, with tears in her eyes.

CSB investigators first developed a long list of recommended improvements - including additional alarms, gas detectors, training - after DuPont company managers pushed to restart the pesticide unit in August; DuPont has now agreed to delays and has accepted some, but not all, of the CSB findings. The pesticide unit remains idle.

At the hearing, attorneys for the families of those killed at the La Porte plant took DuPont management to task for prioritizing its bottom line over employee protection in the wake of the deaths.

"It's shocking to think that DuPont, after these four deaths, was ready to do this startup and ignore the earlier informal recommendations of the investigative committee. Incredible," said Larry Wilson, who represents the family of Robert Tisnado. "But for the interim recommendations, DuPont would have already started its plant."

The CSB's efforts are important, Wilson said, because they are one of the few investigative authorities that helps address systemic operational failures following worker fatalities. He advocated for DuPont to individually monitor worker vitals and install additional cameras around the four-story tower that houses the pesticide equipment.

Brent Coon, a trial attorney representing Jasmine Wise, daughter of Crystle Wise, encouraged the CSB board, which has no regulatory authority of its own, to recommend further regulatory reforms.

Company management, primarily concerned about profits in an industry that has "historically failed to self-monitor," needs to be held criminally accountable in order for substantive change to occur, he said. Penalties like fines are considered "trivial" slaps on the wrist, he added.

"We know these companies are sophisticated," Coon said. "We know they're not ignorant, and we know the reason these things happen is because they cut corners."

Other family members of those killed at the La Porte plant expressed concern about whether the CSB's recommendations would prevent future chemical plant tragedies.
