FIRST SETTLEMENTS ANNOUNCED FROM BP OIL SPILL CLASS ACTION

July 17, 2012 – Houston, TX - Brent Coon and Associates (BCA) is pleased to announce the resolution of its first cases with the BP Oil Spill Settlement program. BCA was assigned numerous responsibilities in assisting with the prosecution of the national MDL proceeding in New Orleans against BP and other parties associated to the casualty and losses from the explosion aboard the Deepwater Horizon in 2010. Brent Coon was chairman of the BP written discovery team in the MDL and served in various capacities with other discovery responsibilities. BCA also served on the separate Vessel of Opportunity discovery program in conjunction with the MDL proceedings.

“The resolution of our initial cases with the new MDL claims settlement process is a solid step and will help many clients avoid the delays and uncertainties associated with waiting for trial dates. I am very proud of our entire BCA team for spending the tens of thousands of man hours necessary the last two years to get us this far and for our firm’s ability to have a substantive role in the largest case ever undertaken in US jurisprudence. We have 15 attorneys and dozens of staff committed to this case and today’s news is a great reward and validation for all of the efforts given to date. We hope to amicably resolve thousands of our cases in this settlement process and also continue to stand ready to go to trial on any claims which are not resolved through this settlement process. For peace, we are always prepared for war”.

BCA represents approximately 15,000 claimants from all regions of the country for losses associated to the oil spill. While most of these claimants are along the Gulf Coast from Texas to Florida, some claimants, particularly in the seafood industry and in services associated to coastal tourism, suffered losses in operations all over the country. This is believed to be by far the largest diversified group of claimants directly represented by any firm in the country.

“Our firm has a long and well respected tradition of handling complex litigation, particularly in matters associated to the petrochemical industry. We single handedly brought BP to justice as a result of the tragedy of the Texas City refinery explosion in 2005, working closely with various state and federal investigative and regulatory agencies. Our work resulted in the prosecution of criminal charges against BP and the settlement of hundreds of claims, both in and out of court. Most important was the ability to create a $40 million dollar charity and refining safety training program from out settlement and the termination from service of every person at BP in the chain of command for what happened there in 2005, from the plant manager through the CEO in London”.


Brent Coon & Associates was the lead counsel in the BP Texas City Explosion of March 23, 2005, representing hundreds of affected workers. Working with the Chemical Safety Board, Department of Justice, the USW and other organizations, BCA released over 7 million documents to the media concerning refinery safety and played a pivotal role in establishing the occurrences of multiple, major safety violations. Conditions of settlements also included a precedent setting charitable donations program which raised 44 million dollars for UTMB, Texas A&M’s Process Safety Management Center, College of the Mainland, St. Jude’s, and the James and Linda Rowe Scholarship foundations. Brent Coon and his client Eva Rowe were awarded the Steven J. Sharp Award for Excellence by the American Association of Justice for their role.

BCA is now aggressively pursuing restitution for 15,000 claimants in the 2010 oil spill, including workers aboard the rig at the time of the explosion, and many people and businesses in the commercial fisheries and shrimping industry, the gulf coast tourism industry and other industries significantly impacted from the explosion and release of 200,000,000 gallons of oil into the gulf waters.
