Breaking: Brent Coon and Associates filed a First Wave of Guardrail Lawsuits Against Trinity Industries
On Tuesday October 27th, 2015, Brent Coon and Associates filed a multi-family lawsuit against Trinity Industries in Dallas County District Court over several separate and tragic wrecks involving these defective “Trinity Guardrails”. Three of these occurrences involved fatalities, and a fourth involved an individual who was seriously and permanently injured. The lawsuit accuses Trinity Industries of Strict Liability, Negligence, Gross Negligence, and Fraudulent Misrepresentation and seeks to recover compensatory damages and punitive damages.

Trinity Industries was found liable for fraud in Texas after it made changes to it's guardrails without informing the Federal Highway Administration as it was required to do so. The company reportedly changed the design of the guardrail as a cost cutting measure. It was reported that according to internal documents Trinity made this fatal design change to save $2 dollars on every rail head. Court documents show that Trinity told Vermont that the design was the same that the Federal Highway Administration previously approved when that was in fact not that case. Ultimately it is believed a patent dispute lead to the discovery of the fatal flaw.
Many states are now banning and or removing all faulty guardrails made by Trinity. There have already been at least 14 lawsuits against Trinity with 5 reported deaths. In North Carolina there is a reported accident that left a driver a double accident a double amputee after falling asleep and hitting a guardrail. On Oct 24, Trinity said they would halt sales of the guardrails effective immediately. Company spokesman said the following regarding mounting Guardrail lawsuits: "“The right thing to do is to stop shipping the product until the additional testing has been completed.” The irony is that the company failed to due the proper testing when they decided to narrow the guardrails channel behind from 5 inches to 4 inches and failed to alert federal authorities. In Arizona alone it is estimated that over 3,000 of the guardrail systems are implemented across the state. The cost to taxpayers in the United States to replace these faulty and deadline cost cutting measures could reach the billions. In 2015, new safety studies should be complete on Trinity Defective Guardrails. The government has allowed Trinity to conduct crash tests to determine how dangerous these potentially deadly guardrails are to the public.
