Headed by attorneys Byron Buchanan and Jennifer O’Brien, the Auto Rollover division focuses primarily on vehicle accidents in which the vehicle provided inadequate safety for the driver and passengers or in which the vehicle or vehicle parts were defective. While most drivers involved in an accident believe the accident was their fault, many times that is not the case. Defective equipment often plays a large role in the cause of an accident. The attorneys at BCA are skilled in investigating auto accidents to determine the true cause and then proving their case in court. The BCA Auto Rollover division specializes in the following types of accident litigation.
Auto Rollover
The rollover is recognized as one of the most violent and dangerous types of crashes for any vehicle. Car manufacturers almost always try to blame driver error as the cause of this type of crash. The truth is some vehicles are much more prone to rollover than others. The tendency of a vehicle to roll over depends on many factors such as the center of gravity and the height, width and length of the wheel base. Technologies such as Electronic Stability Control (ESC) and pre-tensioning devices have been proven to greatly reduce the number of auto rollovers, but vehicle manufacturers have been slow to implement these devices.
Loss of Control
When a vehicle spins out of control, bad things happen. Loss of stability can result in an unnecessary rollover or a collision with oncoming traffic. Some vehicles are unstable and spin much more easily than others. Vehicles with short and narrow wheel bases are particularly prone to directional instability. Once again, ESC devices have shown to help drivers maintain control of their vehicle. In fact, studies show that vehicles equipped with ESC are involved in as much as 80 percent fewer single car accidents.
Tread Separation
A tread separation is different from a blowout. In a blowout, typically the tread of your tire stays on and the tire goes flat. A tread separation may not result in any deflation of the tire. The tread comes off and that one wheel now has slippery steel belts on the road instead of tread. Testing has demonstrated that when a tire suffers a tread separation the vehicle becomes unstable and the opportunity for the driver to regain control is severely compromised. This can lead to a loss of control. Once that happens, the driver becomes merely a passenger and the occupants are at the mercy of where ever the vehicle wants to go. The tire industry has known about the dangers of aged tires for a long time, but has not informed the consuming public about this insidious danger.
Seat Belts and Child Car Seats
Seat belts, when worn properly, should be designed and manufactured to protect a vehicle occupant in all types of crashes. However, we know that in many instances seat belts do not protect the occupants adequately and sometimes cause unnecessary and avoidable injuries and deaths. Known design defects in seat belts include: spool outs, crash unlatching, and submarine injuries. Child restraint seatbelts have also been shown to woefully ineffective in protecting the safety of children.
Roof Crush & Crashworthiness
Some of the early vehicles manufactured in this country had roofs that would resist crushing into the occupant survival space in all but the most severe accidents. Unfortunately, car manufacturers have many times given cost savings, weight reduction and style and marketing programs a higher priority than maintaining an adequate survival space for occupants in a crash. Additionally, the federal government’s minimum standards allow passenger vehicles to pass federally mandated testing even though the roofs are unreasonably dangerous.
18 Wheeler Collisions
A collision between a passenger vehicle and an 18 wheeler is almost always catastrophic. There are some very professional truck drivers and trucking companies operating these big rigs on our highways. Unfortunately, there are some irresponsible truckers taking risks that put our families’ lives in danger. For example, some companies completely disregard federal and state regulations that limit the number of hours a truck driver may operate on the road in a given week. While keeping truck drivers “on the go” expedites their deliveries and, in turn, the trucking company’s profits, it also puts everyone else on the road in unnecessary and preventable danger.
Brent Coon & Associates has the financial and human resources to work up any case involving automobile accidents. Our attorneys in the Auto Rollover division have years of experience investigating and trying these types of cases from beginning to end. They understand the science of accident reconstruction and know how to unravel the corporate structures large companies have in place to try and limit liability of their defective products.
